A three-judge appeals panel ruled on 29 Feb that accused spy Wen Ho Lee remains a flight risk and a security threat and must remain in jail in Santa Fe until his trial, which is not expected before September. A key point in the judicial decision is that seven tapes supposedly loaded with classified information remain unfound. Lee insists that he destroyed or discarded them when he no longer needed the information for innocent work-related research. Lee can appeal the decision to the US Supreme Court. --Stephen V Cole
