David Kernell, 20, of Knoxville, Tenn., the son of state Rep. Mike Kernell, was scheduled to be arraigned Wednesday before U.S. Magistrate Judge C. Clifford Shirley, according to a statement from the Justice Department.

David Kernell was indicted Tuesday by a federal grand jury in Knoxville for intentionally accessing without authorization the e-mail account of Palin, Alaska's governor, the Justice Department said.

Kernell, an economics major at the University of Tennessee in Knoxville, faces a maximum of five years in prison, a $250,000 fine and a three-year term of supervised release.

His father, a Memphis Democrat, is chairman of Tennessee's House Government Operations Committee. Mike Kernell has said he had nothing to do with the hacking incident.

It will be interesting to see who pays the fine when this arrogant pissant is convicted. As an honest incorruptible politician, dad can't have that much dough.

Does anyone remember the penalty the Florida couple that used a scanner to listen in to a cell phone call during the last election?

No? It was on page 78 of the NYT about 2 years after the fact. I believe they got spanked pretty good.

This little felon will probably receive a Fulbright scholarship and run for President in 10 years instead of getting drop kicked into Senior citizenship.

Question:  Will a federal felony conviction make him inelligible to follow in his fathers footsteps?

Depends on the state - most states take away your firearm possession rights and your voter rights.  In addition, many states also will not allow you to run for office or hold an appointed office for a felony count.  You can kiss any TS or SCIF clearance goodbye so working for the Fed or in Congress would have to be limited at best.

He can get a pardon and be eligible for all civil rights (e.g. Marc Rich).

However, in this case, a felony rap for hacking a Republican appears to be both a badge of honor and a selling point for Democrat elections.

This "hacker" didnt actually hack squat.  He got her password changed by successfully guessing and getting through the automated password recovery system.

Be that as it may this little moron should get punishment, but examine the crime.  IT should be a misdemenor or low grade felony.  It was a personal, unsecure email account, he didnt do manipulate the account in anyway, just opened it.

Considering the fact that I have had this happen to my account and nothing in fact was ever done, I dont think his punishment should be to osevere.

Hes a young, foolish idiot, not some terrorist elite hacker.
