Very nasty, but the video isn't great quality. That really did look like attempted murder though. I'm rather tempted to make a joke about table legs, but not really app. :(

I have seen the video. The cop deserves the death penalty, bottom line. Hmmm...a black cop shooting a white man in cold blood. Where are the cries from the white community about cop abuse? We don't do that. Why don't we do that? Because we don't have people like Jesse Jackson and Al Sharpton stirring up our race. These are facts, and heck no, I am definitely no racist. Two of my closest friends are black (or African-American)...and their Parent's do not like Rev JJ or Al Sharpton

First off, he didn't die, last I heard. From what I can see, I agree that the policeman should not yet have resorted to deadly force. However, anyone criticizing the event ought to at least get the story straight, which in my opinion includes the following observations: The victim was being extremely assertive given the situation. I can't imagine why if one cop had me and my buddy on the ground at gunpoint why I would do anything other than whatever the cop told me to do, and only respond when ordered to do so. Instead, he is telling the cop stuff, giving him an attitude, and announcing that he is going to get up. CONTRARY to some reports I've heard, the cop says "don't get up." Granted, the "don't" is rushed and not very clear, but then the "get up" part isn't much better. The victim continues to attempt to verbally control the situation instead of remaining passive, and the cop repeats "Don't get up." The victim starts getting up and the cop shoots him down. In hindsight it would have been far better had the cop said "Stay down" as opposed to "Don't get up." It might also have been far better if the cop had shouted "STAY DOWN!" or at least "DON'T get up!" instead of just saying "don't get up." However, I think it's shakey at best to assume the reason the victim got up was because he thought he heard the cop say "Get up." The victim was already trying to talk the cop into letting him up (for some reason), and certainly never appeared interested in remaining purely reactive to the police officers instructions. Frankly, given the situation and what I would assume would be the "average Joe" response as opposed to the victims response, I suspect at a minimum the victim had been partying and was somewhat intoxicated. I am sure you will agree it doesn't make deadly force reasonable. I also never heard the word "don't", however the sound quality is not great. I fail to see why the policeman would think deadly force reasonable in any case, unless he could see the victim was armed - he could have easily kicked/pushed him to the ground.

Cops these days seem to love being dirty harry these days. It would be interesting to see how tough they are if the service guy's unit showed up at these cops' houses to express their concerns.

"he could have easily kicked/pushed him to the ground." -- Yimmy ---- As opposed to moving into physical contact with the victim, I would suggest a more likely response, and also safer for everyone, would be to shout at the victim to stay down while backing away several paces and moving as necessary to keep both the perpetrators in full view. Continue to command the victim to return to prone, while taking out a can of pepper spray. Give the victim one more chance to comply, and then unload the can in his face. Continue to await back-up. Once other police arrive, tackle the victim, hard. Displacedjim

Now that I've looked at it some more, the victim does appear to me to be reacting to the cop's words, and now I'm inclined to believe he did think the cop was telling him to get up (of course, for some reason he clearly was trying to get the cop to let him up, and was likely predisposed to believe that was what the cop was saying). I'm inclined to think that had the cop firmly said "stay down" the victim might not yet have tried to get up. In any event, I'm sure the cop should have reacted with less than lethal force at that point, regardless of what either had said. Displacedjim

Where was the Cop's Pepperspray? Where was his Tazer? Is the problem that his Municipality is cheap? Or did this man simply not care about Standard Operating Procedure?

Actually you can hear the cop tell him to get up, not once but twice, then he says ok I am going to get up.  Listen to it again.
